VI.Scope of Art.26.1
9 Art.26.1 does not directly and fully apply to all covered agreements listed in Appendix 1DSU,but,pursuant to its first sentence,only to those “where the provisions of Art.XXIII:1(b) GATT 1994 are applicable”.Most agreements ensure the applicability of Art.XXIII GATT 1994 by incorporating it without adding further provisions or adding provisions which are of no relevance to the NVC.Others either have specified provisions limiting the scope of Art.26 or do not refer to Art.XXIII:1 lit.b GATT at all,thereby rendering Art.26 inapplicable.
