1.1Notwithstandinganything contained in Section 1.3 to the contrary,each party hereto shallhave the right (1) to apply to the arbitrator(s) seeking injunctive reliefuntil the arbitration award is rendered or the Dispute is otherwise resolved or(2) without waiving any remedy under this Agreement,to institute judicialproceedings against the other party or anyone acting by,through or under suchother party,in order to enforce the instituting party's rights hereunderthrough reformation of contract,specific performance,injunction or similarequitable relief that may be necessary to protect the rights or property ofthat party,pending the establishment of the arbitral tribunal or pending thearbitral tribunal’s determination of the merits of the Dispute.COMPANY A and LICENSEE each hereby accepts theexclusive jurisdiction of the state and federal courts of the State ofCalifornia for any such preliminary relief actions initiated by either of them.
