我受全體開發(fā)人員之托跟你提幾點要求.希望你能認真對待我們提出的訴求. 因為現(xiàn)在這問題不能再無期限的拖延下去了, 所有人都失去了等待的耐心了. 如果這次不能給我們滿意的答復(fù), 我們將不排除采用法律方式,控告公司的違法行為, 通過法庭的幫助解決這一問題! 我想到那時候公司內(nèi)部將是非?；靵y的. 那是個不開心的結(jié)局.
Dear Mr. Carlos,
On behalf of all the R&D staff, I am here to propose a few requests; hopefully you will treat these appeals seriously because the problem can no longer be dragged on forever, all of us have no more patience left to wait. If we cannot get a satisfactory response this time, we may have to resort to the use of law and let the court help to resolve this problem. By that time I think pandemonium will break loose within the company, and that would be a very unpleasant consequence.
我們一致認為公司沒有設(shè)身處地為我們考慮. 跟員工簽署勞動合同是中國政府要求每一家公司都必須做到的事情, 是維護雇員基本利益的保障. 部分老雇員加入公司都已經(jīng)三年了. 開始我們都相信公司有困難不容易簽合同, 我們都很包容跟理解, 并沒有因為這件事情而消極怠工,反而都先把開發(fā)產(chǎn)品工作做好. 因為我們始終相信先把自己工作做好了公司也會給我們好的福利的. 可是是公司很讓我們失望,沒有很好的做到這一點. 這是不負責(zé)任的行為!
It is our consensus that the company never puts itself in our situations; signing a labor contract with the employees is a prerequisite of a company required by the Chinese government, so as to safeguard the basic rights of employees. Some of the old staff have already served the company for 3 years, initially we all believed that the company was having difficulty in signing employment contracts, so we were all very forgiving and never let this matter affect our work; instead we strived with all our efforts in the work of product development. It was our conviction that if we carried out our work well, the company would remunerate our efforts in return. But the company has let us down, it has never done so and this is absolutely an irresponsible act!
我們知道一個外籍人士在中國注冊公司要很高的費用,還要向政府交納很多稅費.沒有注冊公司的情況下你跟雇員簽署的合約是沒有法律效力,是不能保護雇傭的合法權(quán)益的. 只有正式注冊公司情況下我們簽署的合約才有法律效力. 經(jīng)過所有員工的商議, 都表示理解公司的困難. 同意采用其他方式解決這問題. 現(xiàn)在我把大家的意見寫出來給你們:
We fully understand it is expensive for a foreigner to register a company in China, and he needs to pay a lot of taxes. The employment contracts signed between employees and an unregistered company is legally null and void, it cannot safeguard the rights of employees unless the company is officially registered. After consultations among all the staff, we express our understanding for the predicament of the company; and we are willing to settle the issues by other means. Now I list out our proposals to you:
1.希望公司每年一次支付12個月的保險費(每月每人741元. 每年每人合計8892元人民幣). 由每位雇員自己到社會保險機構(gòu)去繳交. 需要提醒的是: 這保險費每年都有上浮的變化, 不是固定不變的. 所以公司應(yīng)該根據(jù)每年的變化幅度予以調(diào)整.
2. 把過去三年的保險費補發(fā)給我們.
3. 希望公司盡快研究決定. 盡快答復(fù)我們.
1. We hope the company will pay us annually 12 months’ insurance fees ( each person 741 yuan , that comes to 8892 yuan annually for each person); the fees will be submitted to the authority by the employees themselves. Please be reminded that the fees are not constant, so the company should adjust accordingly to the changes.
2. Retroactively pay the insurance fees for the previous 3 years .
3. We hope the company will consider our proposals as soon as possible and give us a prompt reply.
