1.For quantity claim,the claim letter,together with relevant original “Inspectorate” or “SGS” survey report in triplicate issued at discharging port,should be sent at the same time by courier service to the Seller and should reach the Seller’s address (as indicated above) no later than 10 days after completion of discharge at the port of destination.If otherwise,any such claim shall be deemed to have been waived,and the Buyer shall be treated as having accepted the Material in good order.
2.Any claim in respect of any lot of the Material shall not be deemed to be sufficient reason for the Buyer’s refusal to pay for the Material in part or in whole,or for his refusal to accept and pay for subsequent lots of material and for cargoes under other contracts in part or in whole.
3.With the exceptions of late delivery and/or non-delivery due to Force Majeure events,If the buyer fails to open L/C during the time limit agreed upon,to accept material delivered and/or to pay for the material in accordance with the terms of this contract,the buyer shall indemnify the seller for all losses,damages and expenses including but not limited to sales price and/or sales price difference,interest thereof.
