試論商標(biāo)權(quán)與域名權(quán)的沖突及其解決機(jī)制
On conflicts between trade mark privileges and domain name privileges and its solutions
摘要] 隨著互聯(lián)網(wǎng)與知識經(jīng)濟(jì)的發(fā)展帶來了知識產(chǎn)權(quán)保護(hù)上的全新問題,域名和商標(biāo)權(quán)的沖突就是其中較為突出的一個(gè)問題,如何解決二者的沖突,更好地保護(hù)權(quán)利人的合法權(quán)益,成為當(dāng)務(wù)之急.

本文就域名與商標(biāo)的關(guān)系、域名與商標(biāo)沖突的類型及原因、國內(nèi)外域名與商標(biāo)權(quán)沖突的解決機(jī)制及如何完善我國商標(biāo)權(quán)與域名權(quán)沖突解決機(jī)制展開闡述,力求提出我國可采取的對策.
This essay discusses relationship between domain name and trade mark、its conflict types and reasons 、solutions on the conflicts between trade mark and domain name privileges at home and abroad and how to perfect the solutions system in this field in China,striving to offer appropriate countermeasures.
在借鑒國際社會商標(biāo)權(quán)與域名權(quán)沖突解決模式的基礎(chǔ)上,從確立有效的域名注冊審查制度、合理限制商標(biāo)權(quán)人的權(quán)利、禁止反向域名搶注行為、援引反不正當(dāng)競爭法、建立解決域名沖突的專門機(jī)構(gòu)、完善異議制度以及把是否“惡意”作為必備的主觀要件等方面解決問題,從而為傳統(tǒng)經(jīng)濟(jì)和網(wǎng)絡(luò)經(jīng)濟(jì)的發(fā)展提供良好的法制環(huán)境.
Borrowing ideas from the solving models on conflicts between trade mark and domain name privileges in international community,we provide favourable legal system environment for the development of traditional conomy and cybereconomy by establishing valid domain name registration review mechanism、 reasonably restricting rights of trademark obligees、forbidding reverse cyber-squatting conducts、citing The Law of Against Unfair Competition、 and by establishing specialized agency solving conflicts on domain name、perfecting dissidence system and regarding whether“malice”as requisite important subjective document.
