This paper is divided into four parts besides the introduction and conclusion：Part One,Introduce the concept of Non-competition and the legislation value in Labor Contract Law；Part Two,summarize the legislation current situation of foreign law about Non-competition；Part Three, analyse the existent issues of Labor Contract Law about Non-competition clause；Part Four,put forward some legislative proposals base on the problems now.
This paper attempts to improve the stipulates about Non-competition in Labor Contract Law through summarizing Chinese scholars's opinions about Non-competition and contrasting the worth learning from legislative clauses of foreign countries.
