Warranties
Each Party warrants to the other that it has full power and authority to enter into this Contract.
Each Party acknowledges that,in entering into this Contract,it does not rely on any representation,warranty or other provision except as expressly provided in this Contract,and any conditions,warranties or other terms implied by statute or common law are excluded to the fullest extent permitted by law.
Buyer warrants that the Products are suitable for the purposes for which it is purchasing the Products and that it is not reliant on the skill and judgment of the Seller in this regard.
Buyer acknowledges that the Products have characteristics and properties that require careful and enhanced conditions of handling and carriage and warrants that:
(i) the Products will be fully and accurately identified and described in the bills of lading (“B/L”) and in any other contract of carriage to which Buyer is a party;
(ii) Shipowners of the vessel fixed to take delivery of the Products will be provided before loading with a copy of the relevant Material Safety Data Sheet and with appropriate carriage instructions for such Products that properly draw the carrier’s attention to the aforesaid characteristics and properties to adequately ensure the enhanced conditions of handling and carriage required; and
(iii) it will procure that the Master/ Shipowners of such vessel will acknowledge and agree to such instructions.
