Owner shall pay Contractor (i) 15% of the Construction Cost to Contractor on the Notice to Proceed Date as down payment (the “Down Payment”),against issuance of a bank guarantee arranged by Contractor for the same amount from a bank acceptable to Owner in form and substance satisfactory to Owner (the “Down Payment Guaranty”),and (ii) on the Final Completion Date,the balance of the Construction Cost,as adjusted hereunder,owing on the Final Completion Date (the “Final Payment”).
業(yè)主須向合約方支付：第一,15%的建筑費用,作為開工通知書的首付款(“首付款”),由合約方安排銀行保證支付,該銀行須經(jīng)業(yè)主認可同意（“首付款保證書”）,第二,關于實際完工日,建筑預算經(jīng)過調整之后,應在實際完工日支付（“余款”）.
The amount drawable by Owner under the Down Payment Guaranty shall be reduced on the 15th of each month in an amount equivalent to the aggregate expenditures made by Contractor for prosecution of the Work Scope during the previous month,but only to the extent evidence reasonably satisfactory to Owner shall have been provided by Contractor to Owner in respect thereof.
按照“首付款保證書”,業(yè)主的付款數(shù)額應在每月的15日被扣除,金額等于合約方核算的上月施工實際總支出,但合約方提出的其他超常費用須經(jīng)過業(yè)主的許可同意.
Notwithstanding anything in this Agreement to the contrary,Owner shall have no obligation to make any progress or milestone payments until the Final Completion Date has occurred; provided,however,that if Owner issues an Interim Notice to Proceed,Owner shall be responsible for the payment of any amounts due thereunder pursuant to a Request for Payment.Payments owed by Owner to Contractor pursuant to the Interim Notice to Proceed shall,to the extent not paid on time pursuant to the terms hereof,accrue interest at the Late Payment Rate until the date paid in full.
根據(jù)本合同條款,業(yè)主無須在中途支付任何階段費用,直到最終完工日支付余款.除非業(yè)主在中途臨時發(fā)布“繼續(xù)施工通知書”,業(yè)主須承擔由此引起的請求付款的任何費用.根據(jù)“臨時繼續(xù)施工通知書”,業(yè)主須向合約方支付的款項,如果沒有按時按條款支付,將增加“逾期付款率”的利息,直至業(yè)主將余款結清.
