If Supplier, Avaya, or SP determines that any Hardware or the Materials are not in conformance with these warranties, Supplier will, at SP’s or Avaya’s option, repair or replace the Hardware or the Materials so that they conform, at no cost to SP, Avaya, or Avaya’s customers, and with transportation costs and risk of loss and damage in transit borne by Supplier, or provide the purchaser a refund of the price paid for such Hardware or Materials. Repaired and replacement Materials shall be warranted as set forth above in this clause.
